Usually, if there's a winner in the entries for a maiden race (or a winner of 2 races in a NW2, etc), the horse was cross-entered in two races and won the first race. When the entries become final, 24 hours before results, that horse will be scratched by the computer as ineligible, if the owner doesn't scratch the horse first.

So, while the horse ultimately won't run, there can be a period of time where the horse stays in the entry box if the owner does not pro-actively scratch his or her entry.

In that scenario, if there are 13 entries, will the winner be scratched and the 13th horse added to the field, or do they both end up scratched?

If there are 13 entries, and one of them is no longer eligible for the race (because it won a race or won't arrive at the track in time for the race...), the horse will be scratched which will make an opening for the horse on the waiting list.

Another way to say it is that the waiting list is evaluated after any forced scratches happen.
